Auto Accidents/Traffic Collisions

A traffic collision, also known as a traffic accident, motor vehicle collision, motor vehicle accident, car accident, automobile accident, road traffic collision, road traffic accident, wreck (USA), car crash, or car smash (Australian) occurs when a vehicle collides with another vehicle, pedestrian, animal, road debris, or other stationary obstruction, such as a tree or utility pole. Traffic collisions may result in injury, death, vehicle damage, and property damage.

A number of factors contribute to the risk of collision, including vehicle design, speed of operation, road design, road environment, driver skill and/or impairment, and driver behavior. Worldwide, motor vehicle collisions lead to death and disability as well as financial costs to both society and the individuals involved.

Motorcycle Accidents

National Highway Traffic Safety Administration (NHTSA), in 2006, 13.10 cars out of 100,000 ended up in fatal crashes. The rate for motorcycles is 72.34 per 100,000 registered motorcycles. Motorcycles also have a higher fatality rate per unit of distance traveled when compared with automobiles.

CATASTROPHIC INJURIES

A catastrophic injury is a severe injury to the spine, spinal cord, or brain, and may also include skull or spinal fractures. This is a subset of the definition for the legal term catastrophic injury, which is based on the definition used by the American Medical Association. The National Center for Catastrophic Sport Injury Research in the United States classifies catastrophic injuries based on the three outcomes associated with them: fatality, those causing permanent severe functional disability, and those causing severe head or neck trauma with no permanent disability.

Pedestrian V. Auto

An incident where a pedestrian is struck by a vehicle. When a party is struck by a vehicle, there are may factors to take into consideration in determining who is at fault. The greater duty always rests with the driver of the vehicle, however, depending on the actions of the pedestrian, liability may be shared. Therefore, always present yourself to a medical provider immediately and call an attorney to see what your rights are in regards to liability and your recover.

WRONGFUL DEATH

A suit for wrongful death may only be brought by the personal representative of the decedent’s estate. Every state has a civil “wrongful death statute,” or set of statutes, which establish the procedures for bringing wrongful death actions. Actions for personal injury, conscious pain and suffering, or expenses incurred prior to the decedent’s death are also brought by the personal representative. The damage awards from these actions belong to the estate and may pass to different parties as directed by the decedent’s will.

 

SLIP AND FALL

For a property owner to be legally responsible for injuries you sustained from a slip/trip and fall on their property; the owner of the property or an employee must have caused the condition, must have known of the dangerous condition/surface but done nothing about it, or should have known of the dangerous surface because the dangerous condition was reasonably discoverable and would have appropriately resolved the dangerous condition.
