  1. How a personal injury case works

    Every personal injury claim answers three questions: who was responsible, what the injury is, and what it cost. The claim is made to the responsible party’s insurer with the evidence of all three: the incident, the medical record, and the bills and lost income. Most claims resolve with the insurer. If the insurer will not deal fairly, the claim is filed in court, and you are told before that happens.

  2. What drives its value

    The medical record more than anything: what was injured, how it was treated, and whether it will heal. Then the cost, meaning care, income and the effect on your daily life, and the strength of the evidence on fault. A claim is not valued from the first bills; it is valued when the injury is understood.

  3. What the insurer does

    Whoever insures the responsible party will contact you early, ask for a recorded statement, and may make a quick offer. Its job is to close your claim for as little as possible, and an early offer does exactly that. You do not have to speak to it, and you should not sign anything before you have spoken with a lawyer.

  4. How long it takes

    A claim for an injury that heals in a few months usually resolves within a year. Serious injuries take longer because the claim waits for the outcome of treatment. A claim that has to be filed takes longer again. The stage you are at is always explained.

  5. What to do in the first week

    Get medical care this week and follow the referrals. Keep every document and photograph together: the incident report, the names of witnesses, the bills. Write down what happened while it is fresh. Do not give the other side’s insurer a recorded statement or sign anything before you have spoken with a lawyer.

What to do in the days after a collision in California
  1. At the scene

    Stop. Call 911 if anyone is hurt. Exchange licence, registration and insurance details, and photograph the vehicles, the scene and anything that shows what happened.

  2. Within 24 hours

    If anyone was hurt or killed, report the collision to the police or the CHP. If you were hurt, get seen and keep the paperwork you are given.

  3. The same week

    Tell your own insurer promptly; policies require it. Give them the facts and keep the claim number.

  4. Within 10 days

    File the DMV’s SR-1 report if anyone was injured or the damage passed $1,000. It is required even when the police took a report; without it the DMV can suspend a licence.

  5. When the other insurer calls

    You can decline a recorded statement and refer them to your own insurer or your lawyer. Sign nothing about fault.

  6. The weeks after

    Keep the vehicle, the bike, the helmet and any damaged property as they are until they have been photographed and inspected. Keep a simple record: symptoms, appointments, missed work, receipts.

  7. Before you sign

    Ask for the collision report; the LAPD releases it about six weeks after the crash. Do not sign a release or take a quick payment before the injury is understood, because a release ends the claim.

Who pays my medical bills while the claim is going on?

Your own health insurance, if you have it, pays first; medical payments coverage on an auto policy pays early bills regardless of fault; some providers treat on a lien and wait for the settlement. The responsible party’s insurer pays at the end, not as the bills arrive. Whoever paid along the way, health plan or Medi-Cal, is usually entitled to be repaid from the recovery, which is part of what gets negotiated.

I was hurt at work by someone who does not work for my employer. Can I still make a claim?

Yes. Workers’ compensation covers an injury at work regardless of fault, but it does not pay for pain or the full loss of income, and California Labor Code §3852 lets an injured worker also claim against a third party whose carelessness caused the injury: a driver, a subcontractor, a property owner, a product maker. The two claims run at the same time and the workers’ compensation carrier is repaid from the third-party recovery. Tell your employer in writing within 30 days to protect the workers’ compensation side.

Will my personal injury case actually settle, or will it go to trial?

Most California injury claims settle, many of them before a lawsuit is filed and most of the rest before trial. A case is prepared as if it will be tried, because that is what makes an insurer settle it fairly; filing suit is a step in that process, not a failure of it. If a fair offer never comes, a jury decides, and that decision is yours to make with your lawyer.
